    Agreement to Terms

    By accessing or using poshlando.com and related Poshlando services ("Services"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Services.

    Services Description

    Poshlando provides an online platform for browsing and participating in estate sales, auctions, featured items for sale, and real estate opportunities. We facilitate connections between buyers and sellers of antiques, collectibles, estate property, and real estate.

    Accounts

    • You may browse much of the site without an account
    • Creating an account requires a valid email and password
    • You are responsible for maintaining the security of your credentials
    • You must be at least 18 years old to create an account or transact

    Auctions & Bidding

    Certain auctions listed on Poshlando are hosted on third-party platforms (e.g., HiBid). Bidding on those auctions is subject to the third-party platform's terms and conditions. Poshlando acts as a catalog and discovery layer and is not responsible for the conduct or outcome of third-party auctions.

    Estate Finds

    Estate Finds (featured items for sale) on Poshlando are sold directly by Poshlando or on consignment. All sales are final unless otherwise stated in the listing. Prices are in US dollars. Applicable taxes and shipping fees apply at checkout.

    Estate Sale Leads

    Submitting a lead through our estate sale consultation form does not create a binding agreement. All consultations are subject to our availability and acceptance. We will contact you to discuss your needs before any engagement begins.

    Text Messages and Phone Calls

    Poshlando LLC (“Poshlando”) may send text messages about a request, appointment, sale inquiry, purchase or event you have asked us about. These customer-care messages are separate from marketing texts.

    Marketing texts — such as notices about upcoming estate sales, auctions and items — are sent only if you opt in, for example by checking an optional, unchecked text-message box on one of our forms. Opting in is never a condition of buying anything or requesting a service. Message frequency varies. Message and data rates may apply.

    Reply STOP to any Poshlando text to stop receiving texts, or reply HELP for help. You can also email jc@poshlando.com. Mobile carriers are not liable for delayed or undelivered messages.

    We do not sell your mobile number or text-message opt-in, and we do not share them with third parties or affiliates for their own marketing. Calls with Poshlando may be recorded or transcribed, and some calls or messages may be answered by an assisted or automated reception service, where any required notice and consent are given. Our Privacy Policy explains how we handle this information.

    Intellectual Property

    All content on poshlando.com — including text, images, logos, and design — is owned by Poshlando or used with permission. You may not reproduce, distribute, or create derivative works without our written consent.

    User Conduct

    You agree not to:

    • Use the Services for any unlawful purpose
    • Attempt to gain unauthorized access to our systems
    • Scrape, crawl, or harvest data from the site without permission
    • Interfere with other users' use of the Services
    • Submit false or misleading information

    Limitation of Liability

    Poshlando provides the Services "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

    Termination

    We may suspend or terminate your access to the Services at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

    Governing Law

    These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Orange County, Florida.

    Changes to Terms

    We may revise these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
